Re: Agenda Item 5. Legislation of Interest to COMDA
a. AB539 - 3rd and 4th year dental students applying
for RDH licensure
AB539 allows 3rd and 4th year California dental school
students in good standing to apply for a Registered
Dental Hygienist license, which would require completion
of the National written examination and the State clinical
examination. The bill was signed by the Governor and
will be effective January 1, 2005, and COMDA staff
is actively working to implement its provisions. The
bill included an appropriation of $138,000 for the
current fiscal year, and $264,000 each year thereafter.
b. SB 136 (Figueroa) - Registered Dental Assistants
As part of an "omnibus" bill, the portions
affecting COMDA delay for one year (to January
1, 2006) the requirement that all RDAs provide proof
of having
completed both radiation safety and coronal polishing
courses. The bill also provides that an RDA who
possess an inactive license need not comply with
these requirements
until he or she chooses to re-activate the license.
The bill has been signed by the Governor and will
be effective January 1, 2005.
c. SB1546 (Figueroa) - Dental assisting scopes of
practice
SB1546 defines, in statute, the scope of practice
of dental assisting.
The bill was signed by the Governor. Most of its provisions
will be effective January 1, 2007.

Re: Agenda Item 6. Review of RDA Educational Programs
and Courses
Staff and consultants have reviewed the curriculum
and conducted an on-site evaluation of the following
proposed full RDA educational program, and it is recommended
that COMDA recommend provisional approval to the Board.
COMDA staff and consultants then perform another on-site
inspection of the program at a later date to assure
that it is operating appropriately, and then make a
recommendation as to whether the program should be
granted full approval.

Re: Agenda Item 8. Proposed New Regulation - Approval
of Ultrasonic Scaling Courses
RDAs who wish to perform ultrasonic scaling of cement
from teeth under orthodontic treatment must, by regulation,
provide evidence of having completed a Board-approved
course in coronal polishing.
Attached is a proposed regulation that would define
the requirements that such courses must meet for Board
approval.

Re: Agenda Item 9. Proposed Changes to CCR Section
1086 - RDAs Applying Pit and Fissure Sealants
In the past, the Board noticed and heard a proposed
regulation that would have allowed RDAs to apply pit
and fissure sealants (the proposed changes were part
of a package of regulations which would have substantially
revised all dental assisting duties). That regulatory
proposal was ultimately withdrawn because of Departmental
concerns that it would conflict with the provisions
of SB1546, although that bill had not been signed at
the time.
Since that time, SB1546 has been signed and will become
law on January 1, 2005, which adds Section 1777 to
the Business and Professions Code to allow RDAs to
apply pit and fissure sealants in certain public health
settings, after providing evidence of having completed
a Board-approved course.
The attached proposed regulation would allow RDAs
to apply pit and fissure sealants in all allowable
settings, after providing evidence of having completed
a Board-approved course.

Re: Agenda Item 12. Establishment of Fee for Dental
Students Applying for RDH Examination
Beginning January 1, 2005, COMDA will begin implementing
AB539, which will allow certain 3rd and 4th year dental
students to apply for RDH examination and licensure.
The new laws (specifically Section 1725(e)) provides
that, for such 3rd and 4th year students, "the
fee for examination for licensure as a registered dental
hygienist shall not exceed the actual cost of the examination."
Testimony in committee hearings on AB539 included
concerns that the fee to take the RDH clinical examination
does not completely cover the cost of actually administering
the examination, and that current RDH licentiates would
therefore be subsidizing the cost of administering
the exam to dental students in the future (by law,
their RDH licenses will expire 2 years from their passage
of the RDH exam and cannot be renewed).
During COMDA's review of the cost of each program
several years ago, it decided not to change the fee
structure at that time. It was felt that a substantial
increase in the cost to examinees might be a hardship
as they enter the profession, or deter applicants from
entering the profession, when they essentially pay
any additional examination costs through their subsequent
renewal fees, which is currently only $35 per person
every two years.
It is estimated that the actual cost to administer
the examination is currently $479, compared to the
current fee of $150. $479 is only a rough estimate,
since it is impossible to accurately determine the
cost of each program because staff members and all
other expenses are shared by the five different licensing
programs COMDA administers.
It is therefore recommended that COMDA recommend to
the Board that they set the fee, by Board resolution
pursuant to Section 1725, at $475 for such students,
which would be in addition to the normal $20 application
fee.

Re: Agenda Item 13. Proposed Changes to CCR Section

Attached is a proposal from the California Dental
Hygienists' Association (CDHA) to revise the language
of regulation section 1079.2 relating to the requirements
for RDHAP licensure.

Re: Agenda Item 14. Review of Necessity/Desirability
of RDHAP Prescription Requirement
At COMDA's August, 2004, meeting, it voted to pursue
legislation to eliminate the RDHAP prescription requirement.
At the Board's August, 2004, meeting, the Dental Board
agreed with COMDA's recommendation that COMDA work
with the Board's Access to Care Committee to discuss
the issue. Chair Wallace appointed herself and member
Darla Dale to work with that Committee.
However, the Board subsequently decided that the issue
would be heard before the full Board on Friday, November
5th. Attached is the information contained in the Board's
meeting packets.
