Legislation of Interest to COMDA
AB1334 (Salinas)
AB1334, which would eliminate the prescription requirement
for RDHAPs, is in the Senate Committee on Business,
Professions, and Economic Development, but as of March
20, had not been set for hearing.
SB1541 (Ducheny)
SB1541, sponsored by CDA, would establish an on-the-job
training pathway to the dental assisting specialty
license categories that will be established by SB1546
starting January 1, 2008. It is in the Senate Committee
on Business, Professions, and Economic Development,
but as of March 20, had not been set for hearing. Staff
has communicated the following concerns to the sponsor:
1. The bill does not establish a fee for a dentist
who wishes to certify to the Board (COMDA) a person
seeking specialty licensure, although there will be
workload involved in establishing a new computer system,
inputting the data on the individual certified, and
tracking the 18-month maximum period.
2. The bill would allow persons seeking specialty
licensure through this route to perform the specialty
procedures on patients, but does not clearly exempt
such persons from the prohibitions of practicing dentistry
without a license (Business and Professions Code Sections
1626 and 1626.5).
3. The bill would required that a person seeking specialty
licensure through this pathway "Obtain a passing
score on the Dental Assisting National Board (DANB)
exam" (proposed section 1750.4(b)(3)). The bill
does not identify which DANB exam must be passed (DANB
administers several different examinations Certified
Dental Assistant (CDA) credential, comprised of General
Chairside, Infection Control, and Radiation Health
and Safety Examinations; Certified Orthodontic Assistant
credential, comprised of Orthodontic Assisting and
Infection Control examinations; and, Certified Dental
Practice Management Administrator credential). It seems
questionable to require a DANB exam in statute, when
they do not currently administer examinations in all
of the California specialties that SB1546 creates.
In addition, there is no provision for initially and
periodically determining the validity of a DANB examination
(see B&P Section 139), as was done in legislation
mandating that the Dental Board recognize the Western
Regional Examining Boards examination in lieu
of the Dental Boards examination.
4. The bill does not address how a person receiving
a specialty license by this route can then apply
to become a Registered Dental Assistant under Section
1752.5.

Review of RDA Educational Programs and Courses
RDA Educational Programs
Staff recommends that COMDA recommend that the Board
grant provisional approval to the following new RDA
educational programs:
1. Bryman College, San Bernardino
2. Maric College, Bakersfield
3. Maric College, Clovis
4. Valley Career College, El Cajon
5. Western Career College, Citrus Heights
Other Programs and Courses
Any other programs or courses that are ready for consideration
by the meeting date will be presented at the meeting.

Discussion of Status of Implementation of SB1546
(dental assisting scopes of practice)
Attached for reference is the information presented
at the January, 2006, meeting.
Since that date, it has been determined that Chair
Shanda Wallace, and Dr. Ronald Mito from the Dental
Board, are the designated persons from COMDA and the
Board to become involved in discussions regarding the
implementation of SB1546. As of March 20, 2006, a meeting
date had not yet been established.

Re: Agenda Item 8. Delegation
to Executive Officer of Referral of Program and
Course Approvals to Dental Board Executive Officer
At the January, 2006, meeting, COMDA approved recommending
to the Board that it delegate the approval of auxiliary
courses and programs to its Executive Officer in order
to expedite the approval process (see attached information
from last meeting packet). The Board agreed, and a
proposed regulatory change is being prepared for hearing.
However, in order for the process to be truly expedited,
COMDA needs to also delegate its approval of courses
and programs to the COMDA Executive Officer, who would
then in turn make recommendations to the Boards
Executive Officer.
If COMDA concurs, staff recommends
that it delegate to the Executive Officer and Legal
Counsel to draft regulatory language for approval
by the Board at its April meeting. This way, the
delegation from COMDA to its Executive Officer can
be heard at the same time as the regulatory change
that will delegate authority from the Board to its
Executive Officer.
